Terms of Service

Version 1.0 · Effective September 13, 2026

1. Agreement and Eligibility

These Terms of Service ("Terms") govern your access to and use of octo6.com and the related Octo6 applications, APIs, and services (the "Services"). By creating an account or using the Services, you agree to these Terms and our Privacy Policy.

You must be legally capable of entering into this agreement. If you use the Services for an organization, you represent that you have authority to bind that organization.

2. Accounts and Workspaces

You are responsible for accurate account information, protecting authentication credentials, and activity conducted through your account. Workspace owners and administrators control membership, roles, agents, integrations, permissions, budgets, and workspace content. You must promptly notify us of suspected unauthorized access.

3. AI Agents and Outputs

Octo6 helps users configure and operate AI agents. AI outputs may be inaccurate, incomplete, or inappropriate for a particular purpose. You are responsible for reviewing outputs and deciding whether to rely on or use them.

You remain responsible for instructions given to agents and for actions they perform using enabled tools. Approval controls reduce risk but do not replace appropriate human oversight, especially for legal, financial, medical, employment, security, or other high-impact matters.

4. Connected Services and Tools

You may connect third-party accounts, APIs, MCP servers, webhooks, channels, or remote environments. You must have authority to connect them and grant the permissions involved. Third-party services are governed by their own terms and may change or become unavailable.

When you disconnect a managed OAuth integration, Octo6 stops future access and removes the stored OAuth connection. You may also need to revoke access directly with the third-party provider.

5. Acceptable Use

You may not use the Services to violate law or another person's rights; gain unauthorized access; distribute malware; evade security controls; misrepresent identity; facilitate fraud, abuse, or harmful activity; overload the Services; reverse engineer protected portions of the Services; or provide data, credentials, or instructions you are not authorized to use.

6. Content and Intellectual Property

You retain rights in content you submit and grant Octo6 the limited rights necessary to host, process, transmit, and display it to provide and protect the Services. You represent that you have the rights needed to provide that content.

Octo6 and its licensors retain rights in the Services, software, design, documentation, and branding. These Terms do not grant rights to use Octo6 trademarks or branding except as expressly permitted.

7. Plans, Credits, and Payment

Paid features, quotas, and Octo Credit usage are described at purchase or in the Services. Fees are charged according to the selected plan and are subject to our Refund & Cancellation Policy and mandatory law. We may change prospective pricing with reasonable notice. Octo Credits are service-use units, not money, stored value, or transferable property.

8. Availability and Changes

We may update, suspend, or discontinue features, integrations, models, or beta and preview capabilities. We work to provide reliable Services but do not guarantee uninterrupted or error-free operation. We may impose reasonable limits to protect security, availability, users, or third parties.

9. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access for material breach, security risk, unlawful use, non-payment, harm to users or third parties, or when required by law. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations, and accrued payment obligations—will survive.

10. Disclaimers and Liability

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties not expressly stated in these Terms. Octo6 does not warrant that AI output is accurate or suitable for a particular decision.

To the maximum extent permitted by law, Octo6 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from use of the Services. Rights that cannot legally be excluded remain unaffected.

11. Changes and Contact

We may update these Terms and will publish the revised version with a new effective date. Material changes may receive additional notice where required. Continued use after the effective date constitutes acceptance to the extent permitted by law.

Questions about these Terms may be sent to support@octo6.com. These Terms are interpreted together with mandatory laws that apply to you and cannot be waived by contract.
